Another victory in the Washington DC Court of Appeals for Madam’s Organ in another case that should never been brought in the first place.

A victory, but a victory that cost many many thousands of dollars in attorney fees and years of hassle and harassment by DC’s Alcohol Cannabis Control Board

This most powerful Board overseeing DC’s second highest tax-generating industry is made up of NOT ONE MEMBER w BUSINESS or RESTAURANT EXPERIENCE!!!
The only qualification necessary for appointment to this Board is a relationship to The Mayor, a Counsel member or someone influential who lines their pockets
Can you imagine a Medical Board without Doctors? Bar Counsel without a lawyer?
Madam’s Organ has been in business for close to 34 years and in that time we have only had two ABC violations that have stood one of those two involved a drummer who cracked a window open after farting on stage in violation of an agreement to keep our windows closed after 12:30 AM when the live band was playing and the other involved the charge that our doorman did not allow immediate access to an ABC investigator…. That particular violation was upheld even though the appeals court noted that the two investigators had apparently lied in their testimony (one those investigators is not only still employed as an investigator but has now been promoted)
And yet we need to be constantly vigilant that we aren’t subjected to more harassment and more “violations” that must eventually be appealed to the DC Court of Appeals before we are finally vindicated
The non-professionalism and cronyism of this Board, as well as the unsupervised rogue actions of agency employees is out of control. This has left not only my business but many many businesses throughout the city left with no other option than to spend ridiculous sums of money when forced to appeal decisions and fines and, in some cases, suspension or closures imposed by what must be the most nonprofessional board in the city
Something has to change
And change soon
