It is time to dissolve the VBDA Virginia Beach Economic Development! They have done nothing for residents but caused flooding, pollution, traffic and destruction of natural resources so they can PERSONALLY PROFIT along with their own elected representatives- VOTE THEM ALL OUT UNTIL THE VBDA IS GONE!!!

While using code names runs the risk of stirring up rumors, it’s an important part of the secretive interactions between cities and companies in the early stages of trying to land a deal.

This deserves its own post to highlight how overt and egregious the illegal conduct of the Virginia Beach Economic Development and the Virginia Beach City Government is.

The VBDA 'claims' to 'need more land' but why? Do we 'really' have that many businesses who have always dreamed of locating in Virginia Beach? Nope. The VBDA illegally created the circumstances, and councilmembers work endlessly to cover up their misconduct.

Here's what happened...

The VBDA started advertising and soliciting companies as early as 2016 offering them tax incentives, lax environmental regulations, and raw land. The problem being this land was not available (zoned "agricultural" in perpetuity) when the VBDA falsely solicited these companies, and ordinances were never amended.

So city officials and electeds conspire to implement an unwritten citywide 'policy' since they know citizens would never approve of their private venture.

The VBDA advertises agriculturally zoned land below the green line as being 'open for light industrial business' starting in 2016.

Let me repeat that... The VBDA who has no legal authority to rezone land, who does not possess title to the land, and when there is no plan to ever rezone that land since the BRAC Agreement declares, "all land south and west of Princess Anne Road and the green line remain zoned agricultural" -- placing a federal easement over all parcels in the NALF Fentress overlay over 70 dB... The VBDA solicits industrial corporations promising them 'industrial use' of land zoned "agricultural."

The VBDA misrepresented these lands and fraudulently solicited industrial companies -- **falsely promising corporations public land overlayed with federal easements zoned agricultural for "industrial use"**

The VBDA fraudulently promised these companies public land (as well as federal interests in property) for a use that has never been permissible -- now city council is conspiring with the VBDA to rezone agricultural land to industrial so they can fulfill the VBDA's unlawful purpose.

To top it all off, the VBDA with assistance of council attempted to create mechanisms in which to perpetrate this fraud: the TA/ITA Advisory Committee, the Oceana Land Use Conformity Committee, and even went so far as memorializing their unlawful purpose in a document signed by the then-commander of Naval Air Station Oceana.

The VBDA chair is an attorney -- she knows this agreement is invalid and void. Yet, the VBDA has used this to transfer millions of dollars of federal interests.

The Commander of Oceana is without authority to execute an 'IGSA' (terminology the VBDA attempts to use) and even if he had the authority -- the VBDA is limited to leases for "installation-support services."

Neither the VBDA nor the 'commissions' created can modify the zoning designations or transfer federal interests. While City Council can rezone -- they run the risk of being in violation of state and federal law.

State law requires the city abides by the DoD's guidelines for noise levels of 70 dB DNL or greater. The DoD's guidelines can only be modified by a directive or instruction issued by the DoD (not an installation CO) or an amendment to the BRAC Agreement.

Make no mistake -- city council has been repeatedly notified of the illegality of this 'agreement,' and that each transfer is a felony under 18 USC § 641. And with that knowledge council affirmatively acts to rezone parcels for the VBDA, effectively conspiring to steal federal assets each and every time they affirm the VBDA's misconduct.

I am certain Mark Stiles advises councilmembers differently, but they have been notified of his malpractice and choose to follow his advice at their own risk.

I appreciate this sentiment but it will do little to cure the real problem -- the Virginia Beach Economic Development Authority needs to be disestablished. Councilmembers either stand with industrialization and data centers, or they stand with the public.

Virginia Beach is flooding and sinking at an unprecedented rate. When VBDA chair Lisa Murphy classifies wetlands and vacant land as "underutilized land," and has set out to replace forests and open space with concrete and warehouses -- the VBDA has outlast their purpose.

If we are "running out of land" then there's no need for commercialization and industrialization -- take care of your residents. Disestablish the VBDA, strip them of all powers, and let them sit there without the ability to pillage from residents until their debts are paid off.

The scarce land we have left should not be utilized by private interests so they make money and residents suffer.

The commission’s chairperson wrote a letter recommending a briefing for City Council and a potential change to the zoning code.

So, who is lying to whom? Is Virginia Beach City Council lying to residents? Is the Virginia Beach Economic Development Authority lying to everyone?

* There are already data centers in Virginia Beach. Shoot, 'Corporate Landing Industrial Park' is named (and remains named) "Dominion Energy-Certified Data Center Park" starting in 2017 (Sessoms is Mayor)

* Innovation Park was declared 'rezoned' to "industrial" by the VBDA in 2016 -- four years prior to the first illegal rezoning carving out a specific parcel (21 acres) for a specific business (Acoustical Sheetmetal Co.) (Sessoms is Mayor)

* The VBDA announced a preferential tax rate for data centers and their equipment back in 2017 with the purpose of "attracting data centers" (once again under Sessoms). City council has to re-approve this every single year. To say there are 'no data centers' and they 'are against data centers' yet vote yearly on their tax incentive...? Someone is lying.

* And don't let the name and literature fool you. The Southside Network Authority is not there to ensure residents have faster broadband -- it serves to create a tech corridor catering to bringing data centers into Hampton Roads.

The central department lying to everyone is necessarily the City Attorney's Office -- same office where the same attorneys have been caught MULTIPLE TIMES misrepresenting laws and facts. You would have thought the federal court calling out their misrepresentations would have been enough for Council to investigate, remove, and replace all city attorneys, but no.

Regardless, Council is responsible for appointing the city's attorney -- failure to investigate and remove places councilmembers at fault. Being notified, repeatedly, that the city attorneys are operating against public interests and are self-dealing and still failing to even conduct an investigation is inexcusable.

Edit: This does not include the 'good' data centers (i.e. government, medical, non-profit, etc.) listed here are the data centers being utilized for 'connectivity' from the cable landing in Sandbridge --> Corporate Landing --> ITA/Innovation Park --> City of Chesapeake Government DENIED the data center proposed by the Southside Network Authority

Edit: And I can't believe I have to say this but no. These are not the "DoD/DoJ" lines. Meta, Microsoft, Google -- they are all private for-profit corporate data centers and lines.
[Semi-correction: The current administration may actually be using these lines... war plans on Signal, and Truth Social for official presidential statements...but it's not the norm.]
