NOTICE TO OUR CUSTOMERS

Due to a recent change in Louisiana law and limitations with our current payment processing system, we are unable to accept debit cards.
We currently accept cash and credit cards.
We apologize for the inconvenience and appreciate your understanding.

As of August 1, 2026, Louisiana has a new law specifically addressing debit-card surcharges, and it matters for restaurants and other retail businesses.
Under Louisiana Act 751 (SB 254), now R.S. 51:3081–3082, a retail business may not charge a customer an additional surcharge for using a debit card. The statute defines a debit card as a card or payment device that takes funds directly from the customer's deposit account.
So, for example, if a restaurant bill is $100:
Cash: $100
Debit card: must remain $100 — you cannot add a 3% debit fee
Credit card: different rules apply; a properly structured credit-card surcharge may still be permissible, subject to card-network and other requirements.
This is important if your POS is currently adding something like a 3% or 4% “non-cash adjustment,” “processing fee,” or “card fee” to every card transaction. If that fee is being added when the customer uses a debit card, Louisiana's new law can make that unlawful regardless of whether the customer enters a PIN. The statute focuses on whether the card draws from a deposit account.
The law also gives customers enforcement rights. A customer can give the business written notice; if the business refunds the surcharge and cures the violation within 30 days, the statute generally prevents a private lawsuit over that particular violation. Willful, repeated, or uncured violations can create liability, and the Louisiana Attorney General can enforce the law. Violating an administrative or court order can carry a civil penalty of up to $500 per violation.
