Good Morning ,

Despite a week of communication finally with HOME Group Ventures lawyer .

We have been provided with an update last night that we still are being denied access to our belongings.
IE tools of our trade needed to move on with to another location.

That means for 16 days now we have been illegally denied access and have yet to be provided with dates.

Their excuses , it’s not a “convenient “ time for them.
Despite having an on site caretaker who has stated they are available at any time to facilitate the dates we provided to get our belongings and made arrangements around them.

The landlord has not restored hydro after cutting it off to the building and therefore thousands of dollars of food is literally rotting away in the building.
We are expected to clean it all out , or we will be billed for that as well.
When asked for dates to get our belongings and clean out the building .

No answer … stilll waiting , waiting and waiting

Our staff, vendors and appliances that we lease as well as local artists are all waiting.

Again, we legally cannot be denied access, but unfortunately what companies such as Home Ventures Group don’t really care about what is ethical
And legal, and are trying to hold us off knowing we don’t have funds for large lawyer bills at this time.

We have an employee who’s status in the country is dependant upon his employment with us and every day we are held up from moving forward we continue to loose revenue and our resources to do anything to move forward from this nightmare .

Today, we come to you with both gratitude and a heartfelt plea for support. Our beloved restaurant, In Common, has faced unexpected challenges that have led us to a difficult transition. However, our spirit remains strong, and we are determined to restore the heart and soul of our community - In Common.
The recent challenges have not only impacted our dedicated team of staff but also posed financial burdens as we navigate through this transitional phase. We are reaching out to our community for support in this time of need.

We are still awaiting confirmation of accessing our belongings - but tentatively will be hosting an open house / liquidation sale to help recoup any immediate expenses

Monday August 7-9 between 11-4pm for anyone looking to purchase anything from the original space .

For now we are looking for an alternative space but we require immediate funds to help
Us transition and our legal costs to battle this situation.

We thank you and deeply appreciate your support throughout these past 10 days.

It has been brought to our attention by other tenants in the building that the landlords have had people coming and going from our space at night removing items.

This is an update on what’s happening with In Common currently.

We are still locked out with no fair measures to address the issues of the illegal seizure of property after terminating a lease .
A landlord can terminate a lease or cease property they cannot do both.

We have lost over 5000$ in immediate produce and food which could have been used to continue to pay our pay it forwards at this time and staff while we all transition.
When we requested contact last week since July 20 we have not received a single phone call from anyone.

And have been threatened with charges if we attempt to retrieve any of our belongings, as well as further stresses such as civil litigation , knowing fully well we cannot afford a lawyer to take proper legal action for how we have been severely wrong done by this company.

It is a sad day for In Common today, because if you pass by over the next few days. you will see the patio being taken down as a a first step to the business transition plan!

We have fortunately been able to pay our staff for the past pay period. However, we still have staff operating throughout this transition and helping to deal with things from home , which still requires us to pay them. The removal of the patio will allow us some financial relief that we can get our hands on for now.

Unfortunately, this is not a special of the day post.

As you all have already seen and heard the sad news of our landlords ._meadalltribe evicting us 2AM in the morning, we have decided to organise a SAVE IN COMMON PROTEST.

Our space does so much for the community, and have made it a safe space for a lot of folks out there.

We love and appreciate your support, and we are asking you to come join us in our rally today to save our space, our heart!!! 💗

The rally will start at NOON, in front of In Common, 40 Cumberland Street South!

Good Morning Thunder Bay

We would like to notify the community , that after meeting with our landlord yesterday to discuss letting go of the space 42 Cumberland Street ( the old Thyme restaurant) .

Since 2020 we were carrying the space with the hopes of expanding the business .

However , since taking over the space , we have had ongoing issues with the building.
In 2021 the space 42 Cumberland ( empty space ) was condemned by the health unit .

We have had numerous floods in the basement , which the landlords have neglected to care for and now has spread black mold through out the building .

In January 2023 the furnace stopped working and we waited 4 weeks to have it replaced to have heat .
But it was never properly installed and has been leaking water all over.

The landlords have refused to put any work into making the space usable . And we asked to renegotiate the lease to go back to only carrying the original side of In Common.

According to commercial law , since we are on a month to month lease.
Landlords can evict if they so wish for reseizure of the space without reason.

Since both sides are now tied into one lease the landlord has decided to evict us since we do not want to move forward with both spaces.
When we threatened legal action yesterday in the meeting .

They decided to spend us a text at 2am this morning Marley Giunta and Alex Mead .O.M.E Group Ventures . Com saying they were no longer willing to work with us on fixing the space and evicted us from both spaces .

This is not an issue with rent …. But a case of large companies that are not local to Thunder Bay taking over local spaces and neglecting them.

Unfortunately , aside from further legal action on our end .
That is the end of the space as we know it .
