Hey Guys!

We had to close early because we ran out of coffee!! This week has been busier than expected!

Also we want to say a big thanks to all of the kind words, offers to help, and the support we have - it’s incredible and we appreciate it!

We have a long way to go yet and we aren’t giving up!

We will be closed tomorrow - Louie has an appointment in Hobart!

“Why don’t you just walk away?”

This is probably the question we’ve been asked the most since our story came out.

And I completely understand why people ask it.

But walking away doesn’t mean the bills walk away with us.

We have a lease. We have rent obligations. We have equipment on finance. We have ongoing financial commitments that don’t disappear simply because we close the doors.

If TasWater prevents us from operating because the required wastewater infrastructure isn’t installed, the café’s income could stop.

Our financial obligations don’t.

Then people ask: why don’t you just sell?

We’ve tried.

But this unresolved issue now follows the business.

A buyer isn’t simply buying a café. They’re potentially taking on premises with a wastewater compliance issue and infrastructure quoted at around $29,500 — before permits, ground works and other associated costs.

Understandably, buyers don’t want to step into an unresolved dispute about who is responsible for that.

So we’re caught in a position where:

We can’t just walk away.
We can’t simply sell our way out of it.
We can’t ignore the compliance issue.
And we can’t operate indefinitely with the possibility of enforcement hanging over the business.

The responsibility has to be determined.

Under Tasmania’s current system, if that cannot be resolved between the parties, the pathway left to obtain a binding determination is court.

So that’s where this goes if it isn’t resolved beforehand.

Not because we’ve decided to have a fight.

Because there has to be an outcome.

And this is exactly why I’ve been speaking publicly about Tasmania’s retail tenancy laws.

A small business shouldn’t be left in a position where the only way forward is potentially tens of thousands of dollars in litigation just to have its rights determined.

So when people ask:

“Why don’t you just walk away?”

The answer is actually pretty simple.

Because walking away doesn’t end the problem. It just leaves us paying for it.
