Thank you to those of us who have stuck with us following systemic unconscionable conduct via the landlord. You know us as proud supporters of the community, major sponsors of your local football team, volunteers and sponsors of the local surf life saving clubs, and purveyors of great coffee and food.
You may have witnessed that all efforts for the future of our business have been frustrated time and time again as the landlord has not actioned ongoing centre issues (filthy bathrooms, animal waste, broken glass in dining areas, and in the summer plagues of flies invading dining areas due to deficient bins). The issues they permit via a neglect to services, from neighbouring tenants, including Tobacconist selling illegal to***co , have and continue to impact our right and enjoyment of the tenancy.
Over many years we have raised these issues, as have many other tenants (current and past) and the centre has not acted. The ongoing issues with the open overflowing bins, flies in the dinning area, refusal to allow bike racks for cycling patrons (who we lost), and the blocking of new operators to focus on running the business into the future are typical of this landlord.
We have now had our dining area ruined by material loss of natural light which you all previously enjoyed in the winter and the cooling breeze in the summer. They have boarded up /closed in most of our dining area as it suits their plans for a night venue.
Yesterday the car parking spaces many of you use for your SKIP takeaway were removed without consultation once again as our new neighbours renovate their business around ours. As a night venue they obviously don’t care about the sunlight and the breeze for day time diners. Our few remaining diners were asked to move whilst these works continue. The neighbouring tenants leave it for our staff to clean up the dining area after their trades leave dust, footprints, etc.
We are unable to advise you of how many more months of construction, noise pollution (grinders, drills, saws, hammers, music), dust, tradies using our dining area as a passage way, you are to endure as the landlord and the new neighbour have not consulted with us, as is usual for this site.
We have instructed lawyers to deal with the ongoing unconscionable conduct, damages to our right to use and enjoyment of our tenancy, our business and business transactions.
We are aware of a petition by tenants to the landlord and ask any other tenants who wish to initiate action against them, to contact our Company Secretary who will put you in touch with our legal time as we reserve our rights, including participating in a class action.
